General Terms and Conditions

The General Terms and Conditions, regulate the online purchase of all products through the website www.asterartur.com by natural persons of legal age, resident in the European Union (EU), or, if minors, persons authorised by their legal guardian.

The customer undertakes to read these terms and conditions carefully before concluding an order/purchase contract. Unless specifically or otherwise noted by the customer, the customer declares to have fully understood the GTCs and to be in agreement with them. The GTCs are available on the website www.asterartur.com, are made available as part of the ordering process and can also be accessed by sending an e-mail to the general e-mail address (in the form applicable at the time the ordering process is completed).

 

The Seller

The seller is Aster Artur & Co.KG (hereinafter referred to as "ASTER"), with registered office in Sterzing, Neustadt, 34, Italy, UID number: IT01167660214. Further information is available under the heading "Imprint".

Information on products and their availability

All information on the products, with the associated product references, is available on the website. All products offered are subject to availability checks. Aster reserves the right to change the range of products (in terms of numbers, brands, types, models, styles and colours) on the Website at any time. An order may only be placed for a product currently offered on the Website on the terms and conditions specifically stated for that product.

 

Prices

The prices of all products on www.asterartur.com are indicated in euros, inclusive of Italian VAT, and correspond to the Italian list prices.

The prices indicated do not include shipping costs. If owed, the shipping costs will be shown separately to the customer. This will be done before the conclusion of a legally valid order.

Aster reserves the right to change the prices of the products on the website at any time.

Any price changes will not affect orders already received or open.

No liability is accepted for incorrect information or prices on our website.

 

Ordering products

The essential characteristics and the price of the products are displayed on the website.

Before completing the ordering process, the customer confirms to have received, read and understood all relevant legal information (in particular these General Terms and Conditions), which are also provided during the ordering process. With the completion of the order and finally with the conclusion of the legally valid purchase contract, these provisions are binding for both parties.

To complete an order, the customer must create an order request. This is done by means of the forms provided on the website. For this purpose, the customer places the desired products in the "shopping cart". The customer then selects the "Check-Out" function. All selected products, including the purchase price, as well as the calculated shipping costs are displayed to the customer. The applicable value-added tax is shown separately. After carefully reading and accepting the General Terms and Conditions, the customer selects the desired form of payment and makes the payment. The customer then completes the order by pressing the "Send order" button.

By pressing the button "Send order", the customer confirms having received, read and understood the General Terms and Conditions, the shipping conditions, including delivery time and shipping costs, as well as the information on the right of withdrawal. The customer also confirms that all information provided by him/her (including billing and delivery address) has been entered correctly and that he/she is authorised to make payments with the means of payment used. These details will also be communicated to the customer in a separate e-mail. In case of questions or uncertainties, the customer should contact the customer service at online@asterartur.com.

A legally valid order can only be placed by persons who are legally competent according to the law of their place of residence or Italian law (whichever is stricter) and who have therefore reached adulthood.

By clicking on the "Submit Order" button on the Website (and thus submitting the order to Aster), the Customer declares to have understood the information received during the ordering process and to have understood and accepted the General Terms and Conditions.

 

Payments

Part of the ordering process is the authorisation to make payment by the means of payment specified by Aster. Without this authorisation, no order process can be completed with legal effect. The effective booking of the purchase price owed shall only take place after the contract has been concluded.

 

Conclusion of contract

The purchase contract between the customer and Aster exists from the time the order confirmation is sent. This takes place after successful completion, subject to lack of availability of the requested products. The order confirmation will be sent to the email address provided by the customer in the order. Except for obvious technical problems, it is assumed that the customer will receive the order confirmation at the time it is sent.

Should the lack of availability of a requested product be ascertained after the order request has been made, the customer will be informed of this. In any case, Aster reserves the right to partially fulfil an order or not to fulfil it in due time, should individual requested products not be available or only be available within a reasonable delivery period. Products not delivered will not be invoiced to the customer. In the cases described in this paragraph, the customer has the right to cancel the order in whole or in part. No other products will be sent to replace what is not available without the customer's consent.

Aster is not liable for errors in the order process caused by technical problems (such as connection problems), unless these are due to Aster's evident fault.

With the order confirmation, the customer is sent a link to these General Terms and Conditions, information on the products purchased (price and payment method) and information on the statutory right of withdrawal. This e-mail contains all information on the conditions of withdrawal, as well as contact details for the purpose of processing complaints or notifications of defects.

 

Delivery

For each purchase made, Aster will issue an invoice, which will be sent to the e-mail address provided by the customer. The billing address corresponds to the information provided by the customer during the ordering process.

The delivery conditions, including shipping costs, are available on the website and are clearly displayed during the ordering process. The delivery is made as a parcel, by means of traceable and insured delivery. The insurance costs are included in the shipping costs. Damage during delivery is at Aster's expense.

All orders are processed by Aster on working days (Italian calendar). Shipment will normally be dispatched within the delivery date indicated in the order confirmation, unless Aster notifies the customer of its unavailability before the expiry of this period.

Cases of force majeure shall not be borne by Aster.

The Customer undertakes to be present at the delivery address at the time of delivery or to appoint a person to do so. The provisions of the courier apply in this respect

Obvious damage to the packaging must be warned directly by the customer. This is done by refusal of acceptance, a note on the courier's documents or - if acceptance has taken place - by e-mail to Aster, within 72 hours. Within the same period and in the same form, complaints regarding the quantity of the products delivered or other non-conformities must also be made. Defects in the product must be reported immediately, but within 72 hours of their discovery, to Aster by e-mail.

Delivery of the goods to post office boxes is not provided for.

 

Invalid order

In the event of reasonable doubt as to the customer's intention to purchase, Aster reserves the right to refuse to enter into the purchase agreement. This occurs, for example, if Aster has reasonable grounds to believe that the customer is acting with malicious or fraudulent intent, such as if there are reasonable grounds to believe that the right of withdrawal is being abused.

Aster shall inform the customer by e-mail of its intention to refuse to conclude the purchase contract.

 

Right of revocation and return orders

The customer shall be entitled to withdraw the contract with ASTER without mentioning a reason by resending the product to ASTER within 14 (fourteen) days. The right of withdrawal shall be deemed to have been validly exercised if a declaration to that effect, stating the products concerned and the invoice number, has been communicated to Aster by telephone or by e-mail within the specified period.

In this case (withdrawal from the purchase contract), the purchased product must be returned to Aster immediately, but within 21 days of receipt of the product, or returned to Aster's registered office. The return shipment must be made in an insured and traceable package. The cost and risk of the return shipment shall be borne by the customer.

A refund of the purchase price will only be made after receipt and inspection of the returned goods. These must be in unused and undamaged condition and in the original packaging. Otherwise Aster may refuse to refund the purchase price or, at Aster's option, retain any repair or other costs incurred. Any costs incurred in shipping the returned products will not be refunded.

Aster reserves the right to refuse product returns that do not comply with the terms of cancellation.

Returned products must be sent back in the original packaging with the warranty.  Aster will refuse to exchange products that have been lost, stolen or damaged during return.

Should a customer wish to change or cancel an order that has already been placed, he/she must immediately send an e-mail to online@asterartur.com. From the moment the goods are dispatched, the order can no longer be blocked or modified.

 

Replacement of products

Except for the legal right of withdrawal, a right to replacement of the delivered products exists only in case of product defects or other relevant cases of non-fulfilment of the purchase contract by Aster.

The purchase price includes an adjustment of the product to the body measurements. The customer must request such adjustment within 10 days of receipt of the product by sending an email to online@asterartur.com. The adjustment shall be made exclusively by Aster and at its own expense at the company's legal domicile. The Customer shall arrange for the regular and undamaged delivery of the Product to and from the Company's registered office. The cost and risk of transportation shall be borne solely by the Customer.

Any further adjustment will also be charged to the customer.

The warranty as well as the legal right of withdrawal shall expire if the customer himself or a third party makes unauthorised adjustments to the purchased products.

 

Defective products

Defects in the delivered products must be reported immediately, but in any case within 72 hours of discovery, to Aster's customer service:

If it is not possible to remedy the defect, the defective product will be replaced at Aster's expense, unless the customer withdraws from the purchase contract.

Applicable law and Court of jurisdiction

These Terms and Conditions and their interpretation shall be governed by Italian law. Any disputes arising from the interpretation of the validity or execution of these Terms and Conditions shall be governed by Italian law, and the place of jurisdiction shall be Bolzano.
